These Terms apply only to the public website. They do not govern any supply of goods or services, research engagement, collaboration, confidentiality arrangement, employment process or investment process.

Any such activity will be subject to a separate written agreement. If a separate agreement conflicts with these Terms, the separate agreement governs that activity.

The website provides general information about Photon Foundry, its research, technology, capabilities and development plans.

Website content:

• is not technical, engineering, safety, legal, financial or investment advice;
• is not a product specification, warranty or performance guarantee;
• is not a binding offer, quotation or commitment to supply goods or services; and

Research-stage capabilities, prototypes, development targets, expected timelines and availability may change. Any specifications, pricing, availability, suitability, delivery terms or performance commitments must be set out in a separate written agreement.

We may update these Terms prospectively. The current version and effective date will be published on this page, and we will provide reasonable notice of material changes where practicable.

Changes do not retrospectively affect accrued rights or alter a separate written agreement.

These Terms are governed by the laws of New South Wales, Australia. Courts exercising jurisdiction in New South Wales have non-exclusive jurisdiction.

This does not limit rights available under laws that cannot lawfully be excluded.

If part of these Terms is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
